1. The service

Scan My Skincare (previously Fungalscan; "we", "us") provides an iOS application and supporting websites, including FungalScan.app and ScanMySkincare.com, for ingredient checks, label explanations and personal product records. The original fungal-acne assessment remains an optional check using community references. By installing the app or using this website, you agree to these terms.

Verdicts reflect community opinions, anecdotal reports, and heuristic ingredient screening. They are not clinical testing, laboratory analysis, or a medical evaluation of any product.

2. Informational use only

Fungalscan is informational only and is not medical advice, a diagnosis, or a substitute for professional care. Ingredient data and verdicts are provided "as is", with no warranty that they are accurate, complete, or applicable to your skin. Ingredient suitability varies by individual and by formulation. Always patch test, and consult a qualified clinician for diagnosis or treatment decisions.

Fungalscan does not guarantee that any product is non-irritating, allergy-safe, acne-safe, or suitable for any particular skin condition. Fungalscan is not intended for emergency, clinical, dermatological, or medical decision-making.

Analysis depends on reading a label from a photo. Ingredient extraction may contain errors, omissions, or misread text due to image quality, packaging, formatting, or AI interpretation, and a product's actual formulation may differ from its printed label or change without notice.

Any reliance on Fungalscan's ingredient analysis or verdicts is solely at your own risk. You assume full responsibility for any decisions or actions taken based on information provided by Fungalscan.

3. Acceptable use

You agree to use Fungalscan for your own personal, non-commercial use, and not to:

• Scrape, mirror, automate, or otherwise abuse the API or the ingredient database;
• Reverse-engineer, decompile, or attempt to extract source code from the app, except where the law expressly permits;
• Use the service to harass other users, or to misrepresent product safety to consumers commercially;
• Use the service in violation of applicable law.

We reserve the right to throttle, limit, or terminate access for use that breaks these rules.

4. Subscriptions and billing

The app includes a free scan allowance. Additional access is offered through Apple in-app purchases. Available products, local prices, trial eligibility and renewal terms are shown in the app and Apple's purchase sheet before confirmation. Offers may be unavailable in some situations; a website description does not establish eligibility.

Auto-renewing subscriptions renew unless cancelled in Apple account settings at least 24 hours before the current period ends. Apple handles billing, refunds and cancellation. A one-time Lifetime purchase, when offered, is separate from a subscription and does not renew. Existing paid benefits and purchase identities are retained across the app rebrand. Use Restore Purchases in Settings if needed.

Your Shelf and experience records are device-local for launch. Use export/import for backups. Personal observations do not establish an ingredient cause. Removing app data does not cancel an Apple subscription or delete copies you exported.

5. Intellectual property

The Fungalscan name, logo, app, website, ingredient database, copy, designs and code are owned by Fungalscan and protected by applicable copyright, trademark and other laws. You may not copy, redistribute, sell, sublicense, or create derivative works from any of it without our written permission. Third-party ingredient sources and datasets retain their own applicable attribution, copyright and reuse terms; those terms are identified with the relevant content. Descriptive ingredient names do not imply endorsement by their source.

If you believe content or intellectual property is being used improperly on Fungalscan, contact support@fungalscan.app with a description of the material and your contact details, and we will review it.

6. Affiliate links and third-party sites

Some links on this site that point to a retailer are affiliate links, and we may earn a commission if you buy something after clicking one. We are a participant in the Amazon Associates Program. Links that earn us a commission are marked as paid links where they appear, and our handling of them is described in section 6 of the Privacy Policy.

A commission never affects a verdict. Ratings are computed from our ingredient database, and a product is not recommended here unless that same engine returns no fungal-acne triggers for its published ingredient list. Naming a product is not an endorsement of it, a guarantee it will suit you, or medical advice, and section 2 applies to it in full.

Affiliate links lead to sites we do not own or control. We are not responsible for their content, their prices, their availability, their terms, their privacy practices, or whether an order is fulfilled. Any purchase is a transaction between you and that retailer, and any dispute about it is between you and them.

Product information on this site reflects the published ingredient list as of the date shown on the page. Formulations change, and they vary by region. Always read the label on the product you are actually buying.

7. No warranties

To the maximum extent permitted by law, Fungalscan is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that verdicts will be correct for your skin, that the service will be uninterrupted, or that defects will be corrected.

8. Limitation of liability

To the maximum extent permitted by law, Fungalscan and its operators will not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages, or for any loss of profits, data, or skin outcomes, arising out of or in connection with your use of the service, even if we have been advised of the possibility of such damages. Our total cumulative liability for any direct damages will not exceed the amount you paid for the service in the 12 months before the claim.

Any reliance on Fungalscan's ingredient analysis or verdicts is solely at your own risk, and you assume full responsibility for any decisions or actions taken based on information provided by Fungalscan.

9. Indemnity

You agree to indemnify and hold harmless Fungalscan and its operators from any claim, demand, loss or expense (including reasonable legal fees) arising out of your breach of these terms or your misuse of the service, to the extent permitted by law.

10. Dispute resolution and arbitration

Please read this section carefully. It affects your legal rights, including your right to bring a lawsuit in court and to have disputes decided by a jury or as part of a class action.

Informal resolution first. Before starting an arbitration, you agree to contact us at support@fungalscan.app and give us at least 60 days to resolve the dispute informally. Most issues can be settled this way.

Binding individual arbitration. If we cannot resolve a dispute informally, any dispute, claim or controversy arising out of or relating to Fungalscan or these terms will be settled by final and binding individual arbitration, rather than in court, except as stated below. The Federal Arbitration Act governs the interpretation and enforcement of this section. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and may be conducted by telephone, video, written submissions, or in person in the State of Ohio at your option.

Class action and jury waiver. All claims must be brought in your individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. You and Fungalscan each waive any right to a jury trial and any right to participate in a class action. The arbitrator may not consolidate more than one person's claims or preside over any form of representative or class proceeding.

Small-claims exception. Either party may bring an individual claim in a small-claims court for disputes within that court's jurisdiction instead of arbitration.

30-day opt-out. You may opt out of this arbitration and class-waiver section by emailing support@fungalscan.app with your request within 30 days of first accepting these terms. Opting out does not affect any other part of these terms.

If the class-action waiver above is found unenforceable as to a particular claim, that claim will proceed in court rather than in arbitration, while the rest of this section remains in effect. Nothing here prevents either party from seeking injunctive relief to protect intellectual property. Where mandatory law in your country of residence gives you stronger rights, those rights apply.

11. Governing law

These terms are governed by the laws of the State of Ohio, United States, without regard to its conflict-of-law rules. Subject to the arbitration section above, you and Fungalscan agree to the exclusive jurisdiction and venue of the state and federal courts located in Ohio for any dispute not subject to arbitration. Where mandatory consumer protection law in your country of residence gives you stronger rights, those rights apply.
